Comparing trademarks as registered with trademarks as used

This report aims to highlight an important part of the assessment of the genuine use of a trademark, and more specifically when their use differs from the way the mark is registered.

The analysed data covers Opposition, Revocation and Invalidity decisions of EUIPO rendered during the year 2017.

The ✅ indicates that the way the mark was used was accepted as a valid use of the registered mark, whereas ❌ shows that the use was rejected due to the importance of the differences between the sign as registered vs as used.

The references to the decisions in question can be found at the end of the report.
